General Terms and Conditions (GTC)
1. Scope
These General Terms and Conditions (GTC) apply to all contracts for the delivery of goods and the provision of services between Audio Art Galleries (Own.: Effrosyni Kontogeorgou, Address: Serron 4, 19005 Nea Makri Attica Greece) and:
- Consumers who purchase via the websites "https://www.audio-art-galleries.com" and "https://mykonos.audio-ert-galleries.com" (B2C), as well as,
- Entrepreneurs (business customers) who use these websites for business purposes (B2B).
Any differing or conflicting terms and conditions of the customer shall not become part of the contract. For entrepreneurs, differing agreements only apply if they have been expressly confirmed in writing.
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but is an invitation to submit an order. By submitting an order, the customer makes a binding offer. The contract is concluded only when we accept the order by sending an order confirmation via email or dispatches the goods.
Order processing is carried out electronically. Customers will be informed of the status of his/her order via email.
3. Prices and Payment Terms
All prices are inclusive of statutory VAT (EU VAT) and, where applicable, plus shipping costs.
The payment is made by bank transfer or via the payment methods offered in the online shop. Unless otherwise agreed, the purchase price is due within 7 days of the order date for consumers. If payment is not received within 7 days, we are entitled to withdraw from the contract.
Different payment terms may be agreed individually with business customers.
4. Delivery and Shipping
Shipment takes place within 1–5 business days after receipt of payment, unless otherwise indicated for the product. Please note that for orders paid in advance, delivery will only take place after the full amount has been credited to our account, unless otherwise agreed. Items are reserved for a maximum period of up to one week in the case of payment in advance.
The delivery time will be extended appropriately in the event of strikes, lockouts, and other circumstances beyond our control, particularly in cases of force majeure. The start and end of such impediments will be communicated to the buyer without delay.
For deliveries outside Greece, additional costs may arise upon import into a third country (customs duties, possible customs fees, and import VAT). These additional costs are to be borne by the customer.
Shipping within Greece is free of charge (from a minimum order value of 500.00 EUR), unless otherwise agreed.
We reserve the right, in cases where we ourselves are not supplied, to withdraw from the contract if we are not responsible for such non-supply. In this case, we will inform you immediately about the unavailability, and any advance payment already made – regardless of the payment method chosen – will be refunded immediately.
5. Transfer of Risk
For consumers, the risk of accidental loss or accidental deterioration of the goods passes to the customer only upon delivery.
For entrepreneurs, the risk passes to the customer upon handover of the goods to the carrier or forwarding agent.
6. Retention of Ownership
The goods remain our property until full payment has been made. For business customers, title to the goods remains with us until all outstanding payments from the ongoing business relationship have been settled in full.
7. Warranty (Liability for Defects)
For new goods/devices supplied by us, the statutory warranty period is 24 months. For used goods, the warranty period is one year from delivery, unless otherwise specified. In certain cases, the warranty for used goods may be entirely ruled out, since no warranty for used items is mandatory.
You can contact us at any time using the contact methods provided. We will do our best to review your request as quickly as possible. However, please allow us some time, as warranty claims often require involving the manufacturer. When submitting a complaint, please help us by describing the problem as precisely as possible.
For entrepreneurs, warranty claims are limited to provable existing defects and must be reported in writing immediately upon discovery.
8. Withdrawal
8.1 Withdrawal Right
You have the right to withdraw from a contract within fourteen days. The withdrawal period is fourteen days from the day you or a third party named by you, who is not the carrier, takes possession of the last item. To exercise your right of withdrawal, you must inform us about your decision to withdraw from this contract by means of a clear statement (e.g. letter sent by post or email). To meet the withdrawal deadline, it is sufficient to send the notification of exercising the right of withdrawal before the expiry of the withdrawal period. Entrepreneurs are not entitled to a right of withdrawal.
8.2 Consequences of Withdrawal
If you withdraw from a contract, we will credit you for a future purchase all payments received from you, excluding delivery costs, at the latest within fourteen days from the day we receive notification of your withdrawal. We may withhold the refund until we have received the goods back or you have provided proof that you have sent back the goods.
You must return or hand over the goods to us immediately, and in any case no later than seven days from the day on which you inform us of your withdrawal. All returned items should be addressed at: Effrosyni Kontogeorgou, Serron 4, Nea Makri, Attica-Greece, Tel: +30 694 692 7888. You are responsible for returning the goods in their original packaging, with all accessories included, and without any signs of use. You bear the direct costs of returning the goods.

You are responsible for any loss in value of the goods if this loss is due to handling the goods in a way that was not necessary to check the quality, characteristics, and functioning of the goods.
8.3 Exceptions to the Withdrawal Right
There are statutory exceptions to the Withdrawal Right, and several types of goods are exempt from being returned. The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer. The right of withdrawal may expire prematurely for goods that, after delivery, have been inseparably mixed with other goods due to their nature. The right of withdrawal does not apply to audio or video recordings (CD, DVD, cassette tape, vinyl record, etc.), or computer software, supplied in sealed packaging if the seal has been removed after delivery. Furthermore, the right of withdrawal may expire prematurely for contracts for the supply of sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
The withdrawal right also expires in the case of a contract for the provision of services if the entrepreneur has fully performed the service or has started performing the service.
Additionally, excluded from the right of withdrawal are the following business cases:
- Goods which by their nature are not suitable for return, or they can rapidly deteriorate.
- Service contracts, their execution order according to the consumer within 7 working days after the contract is started.
- Sales in which partial payments/installment, lease contracts and/or 'Cash on Delivery' are applied.
- Demo, Used or Modified Products / Devices sold under discount or special conditions.
- Items/Devices not in their original packaging or with missing parts/accessories or damaged items/devices.
- Rental Equipment or Rental Services are totally excluded from any Withdrawal Right.
9. Data Protection
The processing of personal data is carried out in accordance with the GDPR. Our data protection practices comply with legal requirements. Details regarding the collection and use of your personal data can be found in our Data Protection Policy, which also includes information on the practices of third-party platforms.
10. Final Provisions
The operation of the store, as well as all legal transactions or other legal relationships with us are governed by the current Code of Ethics. Without prejudice to the principle of good faith and the principles of good business practices, as well as, the provisions governing legal transactions, in particular those concluded at a distance (where applicable), each user who enters and uses the services of the Store is deemed to consent to and unconditionally accept the terms set forth herein, without any exception. If a user does not agree with these terms, he must refrain from using this Store and from any transaction with it.
In business transactions with merchants and legal entities under public law, our place of business is agreed as the place of jurisdiction for all disputes concerning these General Terms and Conditions and individual contracts concluded under them. Any exclusive place of jurisdiction remains unaffected by the above provision.
Should any provision be invalid, the remainder of the contract remains valid.
